UHope Terms of Service
1. Acceptance and Eligibility
These Terms constitute a binding agreement between you and Junaid Inam, d/b/a UHope. By using the Service, you confirm you are at least 18 years old and agree to these Terms, our Privacy Policy, EULA, and Community Guidelines.
2. Account
Sign in with Apple required. One account per person. iCloud with CloudKit required. You are responsible for your account security.
3. User Content
You retain ownership of your content. You grant UHope a worldwide, non-exclusive, royalty-free license to use it for operating the Service. We may moderate, remove, or restrict content. Messages remain after deletion (sender shown as deleted).
4. Prohibited Conduct
- Harassment, bullying, threats, stalking, or intimidation
- Hate speech or discrimination
- Unsolicited sexual content or exploitation
- Fraud, scams, phishing, or deceptive practices
- Impersonation or misrepresentation
- Use by anyone under 18
- Commercial solicitation or unauthorized advertising
- Reverse engineering, hacking, scraping, or automated access
- Multiple accounts or enforcement circumvention
5. Matching
No guarantee of matches, compatibility, or safety. You are solely responsible for your safety when interacting with users.
6. Subscription
UHope Pro is an auto-renewing subscription. All billing handled by Apple. Cancel 24+ hours before renewal via Apple ID settings. Refunds through Apple.
7. Safety and Enforcement
We may investigate reports, moderate content, suspend or terminate accounts. Automated safety systems may act without prior human review.
8. Intellectual Property
The Service (software, algorithms, ML models, designs) is exclusive property of the Operator. Your license is limited, non-exclusive, non-transferable, and revocable.
9. AI-Assisted Development
9.1 Disclosure
The Service has been developed using AI-assisted development tools ("AI Development Tools"), including AI code generation, AI code review, AI-assisted debugging, and AI-powered development workflows. This is a widely adopted, industry-standard practice in modern software engineering.
9.2 Waiver of Claims
To the maximum extent permitted by law, you waive and release the Operator from all claims arising from: (i) use of AI Development Tools in creating or maintaining the Service; (ii) the nature or methodology of any source code or algorithm; (iii) any defect attributable to AI-assisted code; (iv) the development tools, platforms, or processes used; (v) any claim that the Service was not developed entirely by human programmers. Development methodology is a proprietary trade secret. This waiver is a material term of this agreement.
9.3 California Civil Code §1542 Waiver
California residents expressly waive Civil Code Section 1542: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release."
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, including merchantability, fitness for purpose, and non-infringement.
11. Limitation of Liability
The Operator shall not be liable for indirect, incidental, special, consequential, or punitive damages. Total aggregate liability capped at the greater of: (a) amounts paid in the prior 12 months, or (b) $100.00 USD. This includes claims arising from development tools or methodologies.
12. Indemnification
You agree to indemnify the Operator from claims arising from your use of the Service, your content, or violations of these Terms or third-party rights.
13. Dispute Resolution
Informal first: Contact support@junaidinam.com and allow 30 days.
Mandatory binding arbitration (AAA), single arbitrator, Delaware or videoconference. Class action waiver: Claims in individual capacity only. No class, collective, or representative actions.
Small claims exception applies. Opt-out: Email legal@junaidinam.com within 30 days of first use. Governing law: State of Delaware.
14. Termination
Delete your account from Settings. We may terminate for violations. Safety records retained. Apple, Inc. is a third-party beneficiary.
